La mujer como sujeto activo en el delito de feminicidio a partir del enfoque de la igualdad de género

Abstract

La realización de la presente investigación que lleva por título “La mujer como sujeto activo frente al delito de feminicidio a partir del enfoque de la igualdad de género, la formación de un derecho penal de género no siempre debe ser elogiada. No es habitual que se cuestione la procedencia de personarse al derecho penal y tampoco que se sostenga que los tipos penales de género o las circunstancias agravantes de género contribuyen a la perpetuación de la violencia sistémica. Esto puede ser efectivamente así cuando el recurso al derecho penal es mera coartada para mantener una apariencia de que se hace algo, es decir, cuando el Estado se limita a hacer uso del ius puniendi con fines simbólicos y no adopta paralelamente políticas de género orientadas a remover la desigualdad, en lo referente a la determinación de sujetos activos podemos decir que ante esta nueva realidad frente al nuevo acoplamiento que se ha implantado y que estas necesariamente no son tradicionales, ya que tenemos parejas de homosexuales la cual está compuesta entre dos personas del mismo sexo y en este caso hemos tocado de la relación en cuanto a parejas mujer y mujer (lesbianas). El estudio realizado ese tipo descriptivo y corresponde a la investigación aplicada frente a una nueva realidad que se ha vuelto recurrente y reiterativo que el derecho penal no puede estar de espalda a la realidad social. Para la recolección de los datos se ha hecho uso de la técnica de la encuesta y el análisis documental, los mismos que fueron aplicados a una muestra de dieciocho expertos juristas del entorno local, seleccionados de manera no aleatoria; el análisis documental se hizo sobre la bibliografía pertinente. Los resultados obtenidos manifiestan de manera clara la existencia de posturas distintas en lo referente a la determinación del sujeto activo en el delito de feminicidio, teniendo en cuenta el enfoque de la igualdad de género.

The realization of this research entitled “Women as an active subject against the crime of feminicide from the perspective of gender equality, the formation of a gender criminal law should not always be praised. It is not usual that the origin of appearing under criminal law is questioned, nor is it argued that gender-based offenses or aggravating gender circumstances contribute to the perpetuation of systemic violence. This can be effectively the case when recourse to criminal law is a mere alibi to maintain an appearance that something is being done, that is, when the State limits itself to making use of ius puniendi for symbolic purposes and does not adopt gender-oriented policies at the same time. Remove inequality, in relation to the determination of active subjects we can say that in the face of this new reality in the face of the new coupling that has been implanted and that these are not necessarily traditional, since we have homosexual couples which is composed of two people from the same sex and in this case, we have touched on the relationship in terms of female and female (lesbian) couples. The study carried out is descriptive and corresponds to applied research in the face of a new reality that has become recurrent and reiterative that criminal law cannot turn its back on social reality. For data collection, the survey technique and documentary analysis were used, which were applied to a sample of eighteen legal experts from the local environment, selected in a non-random manner; the documentary analysis was made on the pertinent bibliography. The results obtained clearly show the existence of different positions regarding the determination of the active subject in the crime of femicide, taking into account the gender equality approach.
