La eficacia de la medida socioeducativa de internamiento en los adolescentes infractores en Lima Norte, 2022

Abstract

La presente investigación tuvo como objetivo analizar la eficacia de la medida socioeducativa de internamiento impuesta a adolescentes infractores entre 14 y 17 años en Lima Norte durante el año 2022. Para alcanzar dicho propósito se hizo uso de una investigación básica, de enfoque cualitativo y cuya técnica fue la entrevista que se aplicó sobre una muestra de tres jueces y cuatro abogados, los cuales están encargados de aplicar dichas medidas. Para el registro se hizo uso de la guía de entrevista como instrumento. Los resultados muestran que existe poca eficacia al aplicar dichas medidas por la judicatura, resaltando que se produce reincidencia por parte de los menores infractores en su retorno a la sociedad. La conclusión principal es que la eficacia de las medidas socioeducativas se encuentra en relación directa con una asistencia post punición que implique tanto al aparato estatal como al entorno familiar.

The objective of this research was to analyze the effectiveness of the socio-educational measures imposed on adolescent offenders between 14 and 17 years of age in North Lima during the year 2022. To achieve this purpose, basic research, a qualitative approach and techniques such as survey and interview which were aided by instruments such as the questionnaire and the interview guide. These materials were applied to a sample composed of four judges who were interviewed, as well as six legal operators, including lawyers and public servants, who were surveyed. The results show that there is little effectiveness in the measures established by the judiciary, highlighting that there is recidivism by minor offenders in their return to society. The main conclusion is that the effectiveness of socio-educational measures is directly related to post-punishment assistance involving the state apparatus and the family environment.
