Law No. 30407 establishes that the animal is a sensitive being and therefore deserving of good treatment by the person, in addition in turn in article 22 it incorporates the express prohibition of using animals as a means of entertainment shows in where their well-being and physical health are conditioned, however the Law in question by means of the first final complementary provision excludes from the scope of criminal protection the crime of abandonment and acts of cruelty against domestic and wild animals to cockfighting and bullfighting shows of bulls for being declared cultural by the competent entity, there being no resolution issued by the Ministry of Culture in this regard, it must also be taken into account that the shows in question compromise the physical and psychological well-being of the animal, however based on the principle This precautionary assumes that the damage to the animal does not need to be scientifically demonstrated since evidence of e that the act infringes pain, injury, serious or irreversible damage for the state to issue actions against it, however, this can be evidenced at first glance with the lethal end of the animals subjected, which is painful death, conditioning thus the welfare of the animal on its physical and psychological level. So much so that the present investigation was carried out in order to determine how the exclusion of bullfighting and cockfighting from the scope of criminal protection provided for in the First Final Complementary Provision of Law No. 30407 affects the legal right protected by the crime of abandonment and acts of cruelty against domestic and wild animals regulated in article 206-A of the Penal Code.
