Los criterios de los jueces labores para determinar los costos procesales y su incidencia en el pago de los honorarios de los abogados

Abstract

El presente trabajo de investigación centrará su atención en identificar los criterios establecidos en las resoluciones emitidas por los Jueces Laborales de La Libertad para determinar los costos procesales, y cómo es que éstos influyen sobre los honorarios de los abogados, los mismos que han sido pactados de manera libre y voluntaria, generando consecuencias negativas: Que los clientes no cumplan con pagar el honorario pactado previamente con el abogado, entendiendo a éstos como sinónimo de honorarios profesionales; no obstante en el desarrollo del problema se explicará que si bien son conceptos relacionados (costos y honorarios profesionales) en la práctica, corresponden a relaciones jurídicas diferentes.

This research work will focus its attention on identifying the criteria established in the resolutions issued by Labor Judges of La Libertad to determine the procedural costs, and how they influence the attorney´s fees, the same that have been agreed upon by freely and voluntarily, generating negative consequences: That the clients do not comply with paying the fee previously agreed with the lawyer, indicating that the judge has already set the procedural costs, understanding them as synonymous with professional fees; however, in the development the problem, it will be explained that although they are related concepts (costs and professiona fees) in practices, they correspond to legal relationships that are immersed in each of them.
