The main objective of this research is to analyze how the principle of due process was complied with in the disciplinary regime for teachers within the framework of Law No. 29944 - Teacher Reform Law at UGEL 04 during the year 2019, in its dimensions of compliance with the right to defense and due motivation. For this purpose, the present investigation was developed within the framework of the qualitative approach, of a basic descriptive type, of phenomenological - hermeneutical design; The technique applied was documentary analysis, as a population, all disciplinary administrative procedures that imposed sanctions were chosen and that obtained a firm resolution in 2019; and the sample consisted of twenty (20) cases. It was identified as the main finding that the Magisterial Reform Law is complemented by the General Administrative Procedure Law and others in order to guarantee due process, however it has been proven that not one hundred percent since it has been concluded that, in the disciplinary regime applied to teachers, regulated under Law No. 29944 - Teacher Reform Law, the processes were processed in an irregular manner, since the transgression of due process was noticed, a principle embodied in the Political Constitution of Peru, which would become in a serious affectation to the fundamental rights of teachers, in its dimensions of duty to due motivation and the right to defense.
