The purpose of this investigation is to establish that the digital identity control of the National Police of Peru (PNP), does not violate the rights of any person participating in any march, rally, protest, blockade, among others; because the identity control of the PNP is an attribution that has been granted, as part of the framework of its powers, in order to preserve internal order and likewise, prevent crime, as stipulated in the Political Constitution of Peru. It should be noted that these actions called demonstrations are part of the citizen's right to free expression. There are some cases in which these become alarming events with consequences of victims who lost their lives in the act, as a result of hysteria, the burden and fury with which many of them behave, and to this is added the attitude of subjects or individuals of bad living, who also participate in these events, only for the purpose of whipping up the demonstrators, Therefore, this power delegated to the PNP on identity control, has the mission to ensure and restore internal order in situations of this caliber, thus ensuring compliance with the laws and the security of public and private property, as stated in Article 166 of the Political Constitution of Peru. The Ministry of Justice and Human Rights defines this police identity control procedure as the need for personal identification carried out by police officers on public roads or in any random location where the request is made, when it is deemed pertinent to obtain useful information for the investigation of a punishable act or to prevent a criminal act. To this effect, the law enforcement officer is allowed to proceed with the necessary verifications. According to the Office of the United Nations High Commissioner for Human Rights, human rights are universal and intrinsic to all human beings, as legal guarantees that protect them and watch over their rights and human dignity, without these being violated by any agent of the State, without any justification whatsoever. In the same way in which the Vienna Declaration of 1993 mentions, “human rights and fundamental freedoms are the innate heritage of all human beings; their promotion and protection is the primary responsibility of governments“. For the realization of the present research, different national or international research works have been used, in addition to various articles from newspapers and indexed magazines, in order to provide academic support. The present applied research is a non-experimental design, which was conducted under the quantitative approach applying the technique of opinion survey a 30 police officers, from the main police stations of Metropolitan Lima, among which are Ate-Vitarte, Barranco, Breña, Cercado de Lima, Chorrillos, Comas, El Agustino, Independencia, Jesús María, La Molina, La Victoria, Lince, Los Olivos, Lurín, Magdalena, Miraflores, Pachacamac, Pueblo Libre, Puente Piedra, Rímac, Salamanca, San Borja, San Isidro, San Juan de Lurigancho, San Juan de Miraflores, San Luis, San Martín de Porres, Santa Anita, Villa El Salvador and Villa María del Triunfo.
