The thesis entitled “The repeated application of the Principle of Opportunity in the preliminary stage of the investigation of the crime of Omission to Family Assistance and its impact on the Principle of the Superior Interest of Children and Adolescents“ had as main objective to determine how Legal operators Use this procedural instrument in the offense to omit family assistance, acting without foreseeing what expressly established by the norm, in article 2 subsection 9) of the Code of Criminal Procedure and in this way affect the rights immersed in the Superior Principle Interest of the Children and Adolescents and International Law. In this context, the first chapter explained, through the study of different national and international authors, the scope of the Opportunity Principle and its conceptualization within the national and international legal, jurisprudential and legal framework, the basis for its application and the Importance within the Preliminary Investigation carried out by the offices of Advance Decision of the Public Ministry of Trujillo. The second chapter has developed the Omission to Family Assistance as a legal figure, conceptualizing the origin of the crime as they are; Food and legal goods violated before the behavior typical of the active subject, in addition the scope of food in its broad conception. Taking into account, the development provided by Civil Law, necessary for the particular purposes of research Finally, the third chapter develops what concerns the scope of the Principle to the Superior Interest of the Child and the Adolescent, its conceptual development and the legal certainty that prevails the State not to violate this right and constitutional principle. Also, the development of international legal protection.
