Resumen: La presente investigación se justifica en la necesidad de cubrir el vacío legal que se
tiene en el Perú, dando prioridad a un grupo considerable de mujeres infértiles que buscan
ser madres y constituir su propia familia nuclear. En esa línea temática, el objetivo general
es determinar qué relación existe entre la maternidad subrogada y su regulación en la realidad
peruana, 2020; por lo que según la metodología aplicada es una investigación de tipo básica,
con un enfoque cualitativo, diseño de tipo no experimental, y de nivel descriptivo; por otro
lado, se seleccionó como muestra; las sentencias del Poder Judicial y del Tribunal
Constitucional vinculado a las variables de investigación; así como las entrevistas
practicadas a expertos en el área de derecho constitucional, civil y de familia. Obteniéndose
como resultado que es urgente la necesidad de incorporar la maternidad subrogada en la
legislación peruana a fin de brindar la protección a las partes intervinientes; concluyéndose,
que no existe regulación normativa que proteja a las mujeres infértiles, en relación a la
maternidad subrogada para constituir una familia nuclear; sin embargo, se evidencia la
existencia de derechos fundamentales que protegen a la familia; como el derecho a la salud
reproductiva, libre desarrollo de la personalidad y a fundar una familia.
The present investigation is justified by the need to cover the legal vacuum that exists in Peru, giving priority to a considerable group of infertile women who seek to be mothers and establish their own nuclear family. In this thematic line, the general objective is to determine what relationship exists between surrogate motherhood and its regulation in the Peruvian reality, 2020; so that according to the applied methodology it is a basic type of research, with a qualitative approach, non-experimental type design. , and descriptive level; on the other hand, it was selected as a sample; the judgments of the Judiciary and the Constitutional Court linked to the research variables; as well as the interviews with experts in the area of constitutional, civil and family law. Obtaining as a result that there is an urgent need to incorporate surrogate motherhood in Peruvian legislation in order to provide protection to the parties involved; concluding that there is no normative regulation that protects infertile women, in relation to surrogate motherhood to constitute a nuclear family; however, the existence of fundamental rights that protect the family is evident; such as the right to reproductive health, free development of the personality and to found a family.
