La gestión de la Oficina de Peritajes en el Ministerio Público y su problemática con la Fiscalía Especializada en Delitos de Corrupción de Funcionarios de Lima, 2019-2020

Abstract

El presente trabajo de investigación tuvo como finalidad investigar de qué manera se viene realizando la labor de la Fiscalía Especializada en Delitos de Corrupción de Funcionarios de Lima, 2019-2020, y determinar la cantidad de peritos especializados con los que cuentan para brindar apoyo en la realización de las acciones de investigaciones vinculadas a las Carpetas Fiscales que tienen a su cargo, así como si estos cumplen con los requerimientos mínimos necesarios para la realización de una labor eficaz y eficiente; asimismo, conocer si la Oficina de Peritajes cuenta con el material logístico necesario para el desempeño de las labores de los peritos especializados; aspectos que deben ser acordes a los requerimientos de la entidad y la sociedad en la que vivimos; esto en razón de que nuestro país se encuentra actualmente azotado por actos de corrupción a gran escala, los cuales desestabilizan los bases institucionales del Estado. Es por ello, que se desarrolló una investigación de tipo cualitativa, a fin de recabar información documental, así como de parte de sujetos expertos en la materia que puedan brindar un panorama adecuado que lleve a una interpretación idónea para encontrar, de ser necesario, soluciones a la problemática que se viene presentando en la Fiscalía Especializada en Delitos de Corrupción de Funcionarios de Lima vinculada a la necesidad de peritos especializados, así como del material logístico para las labores de los mismos, la cual tiene una repercusión negativa en las investigaciones fiscales vinculadas a actos de corrupción en la zona. Es así que, se concluyó que, en la actualidad, la carencia de del aparato logístico necesario, así como la cantidad de personal en la Oficina de Peritajes, así como la capacitación del mismo, no permiten el eficaz desarrollo de la labor del Subsistema Anticorrupción, la cual es de extrema importancia, dada la actual realidad en que vivimos, ya que, el Ministerio Público, como titular de la acción penal y defensor de la legalidad, es el único organismo encargado prevenir y reprimir la realización de actos delictivos, así como velar por los intereses de la sociedad.

The purpose of this research work was to investigate how the work of the Office of the Special Prosecutor for Crimes of Corruption of Officials of Lima, 2018-2020, is being carried out, and to determine the number of specialized experts they have to provide support in the carrying out the investigation actions related to the Fiscal Folders that they are in charge of, as well as if these comply with the minimum requirements necessary to carry out an effective and efficient work; likewise, to know if the Office of Experts has the logistical material necessary for the performance of the work of the specialized experts; aspects that must be in accordance with the requirements of the entity and the society in which we live; This is because our country is currently plagued by large-scale acts of corruption, which destabilize the institutional foundations of the State. That is why a qualitative research was carried out, in order to collect documentary information, as well as from experts in the field who can provide an adequate panorama that leads to an ideal interpretation to find, if necessary, solutions to the problem that has been presented in the Office of the Special Prosecutor for Crimes of Corruption of Officials of Lima linked to the need for specialized experts, as well as the logistical material for their work, which has a negative impact on related tax investigations to acts of corruption in the area. Thus, it was concluded that, at present, the lack of the necessary logistics apparatus, as well as the number of personnel in the Expert Office, as well as the training thereof, do not allow the effective development of the work of the Anti-Corruption Subsystem. , which is extremely important, given the current reality in which we live, since the Public Ministry, as head of criminal action and defender of legality, is the only body in charge of preventing and repressing criminal acts, thus how to look after the interests of society.
