ABSTRACT The present study was aimed to determine the resolving effect generated by the legal risk uncertainty, as allocation factor of the objective tort liability regulated in the Peruvian Civil Code, in judgments issued by justice bodies of Peru in controversies on the matter. To this end, there has been made a qualitative study, of descriptive-explanatory type, and no experimental design, performed through a review of literature sources and analysis of the judgment’s arguments issued by the Republic Supreme Court and the High Courts of Justice in the country. The results establish that the judgments evaluated suffer from improper motivation, in different forms, and conclude that this situation is caused by lack of legal definition and lack of uniformity of doctrine on risk criteria; makes impossible for Civil judges to take a valid position that may be held when resolving disputes on the matter.
