The present investigation finds its purpose in the Settlement of the Arbitration Costs in the Arbitration Award, that is, the expenses of the plaintiff, fees and expenses of the Arbitration Court, fees of their lawyers who sponsored the arbitration process, administrative expenses of the arbitration institution, the fees and expenses of experts or any other assistance required by the Arbitral Tribunal, the reasonable expenses incurred by the parties to defend them in the arbitration, other reasonable expenses derived from the arbitration procedure and finally, in the subsequent execution of the award in the legal process. judicial. The expenses that the parties make in the arbitration can be frustrated if the liquidation of arbitration costs was not carried out at the time of issuing the Arbitration Award, therefore, they generate consequences in the processes of execution of arbitration awards in court, that is why that, in the face of the omission of the liquidation of arbitral costs, the judges, (in this case, the magistrates of the courts and civil chambers of the Superior Court of Cajamarca) in the fulfillment of their role within the process of enforcement of the award, encounter problems to achieve the efficiency of the execution, that is why the arbitrators have the responsibility to liquidate the arbitration costs in the Arbitration Award, in such a way that at the time of executing the award, the magistrates have the facility to resolve the forced execution.
