The purpose of this investigation has been to determine the observance of the right to due process in the application of disciplinary sanctions to the inmates of the Cajamarca prison, period 2021, through a qualitative approach with a non-experimental design. To this end, information has been collected using the interview and the questionnaire as an instrument, and analyzing the minutes of the prison technical council for the year 2021. The results obtained have been able to determine that the observance of the right to due process of the inmates of the penal establishment of Cajamarca in the disciplinary administrative process is in PROCESS, a reality that determines that it is necessary to continue working to improve the observed situation and reach the level of ACHIEVED. The conclusions managed to identify that the procedural guarantees that are being breached within the due process in the application of disciplinary sanctions to the inmates of the Cajamarca prison, period 2021, are: the right to the presumption of innocence, effective procedural protection, right of defense and due process. All these rights are affected due to the management of the Cajamarca Penitentiary Center, which is slow in its procedural actions, added to this is the lack of training of the members of the decision-making body.
