Resumen: Durante los avatares del desarrollo histórico del Derecho del Trabajo, son dos las
instituciones jurídicas que, con harto contenido social, han sido pretensiones arraigadas a
la lucha obrera y sindical, centro de disputa constante entre los trabajadores y el empresario
capitalista: la jornada de trabajo y la remuneración. Así, la presente investigación se centra
en el estudio de la vinculación de ambas instituciones en la producción de uno de las
actividades comunes en la realidad del mercado laboral, cual es la contratación del trabajo
por pago a comisión, es decir, en la constitución de aquellos vínculos de trabajo donde el
salario es cancelado a razón de las ventas, cobranzas u otras operaciones comerciales
ejecutadas por el laburante. Ello especialmente en los efectos que aquella genera en la
jornada de trabajo del dependiente; considerando que en la realidad los comisionistas,
debido a las condiciones y características de su labor, suelen estar excluidos del derecho
a la limitación de la jornada de trabajo, de modo que aun cuando el Convenio N° 01 de la
OIT (Organización Mundial del Trabajo) en su artículo 2° establezca como derecho
fundamental y humano de todo trabajador el tener un límite a su tiempo de trabajo, como
asimismo lo reproduce en el artículo 25° de nuestra Constitución, ello no sería aplicable al
laburante comisionista.
En tal sentido, esta investigación ha partido particularmente de la observación de la
realidad trujillana, en donde los órganos de justicia laboral de la Corte Superior de Justicia
de La Libertad, analizando y resolviendo sobre el encuentro de estas dos instituciones en
la exclusión del derecho a la limitación de la jornada de trabajo del comisionista, han
establecido que la sola condición de la comisión como forma de pago en el contrato de
trabajo, hace posible la exclusión del laburante contratado, del límite de la jornada máxima
legal, debido a la énfasis que en ella adquiere la producción y los resultados por encima
del tiempo de trabajo; precisando que al margen de la situación en la que se desarrollen
las labores, ya sea fuera o dentro del centro empresarial, la sola constitución de los
resultados como objeto del trabajo y del salario, reducirá las necesidad de supervisar la
utilización efectiva del tiempo de trabajo y otorgará lapsos de descanso en la jornada según
el ritmo de las ventas o demás operaciones comerciales, de modo que el trabajador, de
acuerdo a los supuestos previstos por nuestra legislación, se encontrará excluido por
ausencia de fiscalización inmediata e intermitencia en su trabajo.
Así, ante la problemática e interrogantes que tal circunstancia plantea, esta investigación pretende, a partir del análisis de las instituciones jurídicas y conceptos relacionados en la misma, arribar a una conclusión y resolución satisfactoria que se acomode más a los principios del derecho del trabajo y a los derechos fundamentales de trabajo de los comisionistas.
Through the conflicts in the labor law´s history, there are two legal institutions with a heavy social mean, that had been continually claim at the worker´s protest and strikes, and that had been also the center of many disputes between workers and capitalist employers, this are the working period and the salary. Therefore, this investigation attend the study of the legal relationship between both institutions, mainly in one of the most common events on the labor market, which is the commissions agents work contract, meaning those labor hiring’s where the salary is pay as a result of the quantity of products, sells or any other commercial operations, that the worker made. That especially about the effects that this salary pay mode cause on the work period of the dependent; knowing that in the reality of the labor relationships, the commission agents are commonly excluded from the limitation of the work period, because of the particular conditions and features of their job. So, even when the Convention N° 01 of the ILO (International Labor Organization) in its second article, establish the limitation of the work period as a human right, as so it does our Constitution in its article 25°, that wouldn’t be applicable to the commission agent. In that sense, this investigation have started particularly from the observation of the Trujillo´s reality, where the labor courts of justice analyzing and solving about the relation of this two institutions on the exclusion of the commission agent of the limitation of the work period, have established that just the covenant of the commission as the salary paying mode is enough to sustain the exclusion, because of the emphasis that its generates on the quantity of the production over the working time. So, notwithstanding how the labor of the commission agent its make, whatever its outside or inside the labor center, just the constitution of the production and results as the objective of the work and the salary, will generated the reduction of the need to control the effective use of the working time, and will give to the worker many rest periods as the rhythm of its sells or commercial operations goes. In that way, according to the law, he will be excluded because of no need of immediate audit and the presence of intermittent lapses on his job. Therefore, facing the problematic and the questions that this circumstance shows, this investigation pretends, due to the analysis of the legal institutions and concepts that are linked, to arrive to a satisfactory conclusion and resolve that follows the labor law principles and the worker rights of the commission agents.
