ABSTRACT The administrative contentious action is the right that the constitution grants us, to question the function and / or decision of the public administration. In the case of the study, the administrative litigation begins after the plaintiff's request is declared inadmissible. In the judicial process, the leveling of the applicant's pension is discussed in terms of Supreme Decrees N ° 065-2003-EF and 056-2004-EF, which granted a special allowance for effective pedagogical work. The plaintiff ceased the year 1991, and is under the regime of Decree Law No. 20530. The dilemma arises in the application of Law No. 28389 - Law of Constitutional Reform, which modifies the interpretation that should be given to the laws , changing from the Theory of Acquired Rights to the Theory of Facts Accomplished. Regarding the case, the court of first instance, gave the reason in part to the plaintiff. Because the Supreme Decrees were promulgated before the Constitutional Reform, and after that the leveling of pensions with remuneration was prohibited. Decision questioned by both parties. So when rising to the Superior Chamber, it declares the claim unfounded. Unfortunately, the Civil Chamber does not duly motivate, which is questioned in the appeal filed by the plaintiff. Which is granted. Therefore, the Second Chamber of Constitutional and Social Transitional Law orders the Superior Chamber to issue a new judgment. The second hearing decision issued by the Civil Chamber reiterates its decision, stating that the Supreme Decrees prescribe that they only correspond to teachers in activity and are not subject to social charges. However, the plaintiff, not content with the decision, returns to file an appeal for cassation, requesting that they rule on the merits of the matter. Which is declared inadmissible. Like this, several processes have been initiated before the Judiciary and a mistaken interpretation has been issued in the application of the Constitutional Reform and the legal nature of the assignments granted by the Supreme Decrees, although the discussion has been clarified over time , there being predictability in the judgments of the judges.
