Abstract: La presente investigación realiza un análisis a la normativa del adulterio como causal de
divorcio en el derecho civil peruano, con el objetivo de demostrar lo difícil que es para el
cónyuge agraviado invocarla, debido a la naturaleza limitada que lo enviste.
Ante ello, una norma jurídica sólo será eficaz si coexiste con las acciones procesales,
instrumentos, medios o recursos necesarios para invocarlas a fin de obtener la Tutela
Jurisdiccional Efectiva.
Por lo tanto, a partir de un análisis a la jurisprudencia nacional se busca evidenciar los
fallos de infundabilidad de los jueces, cuando se plantea el adulterio como causal de
divorcio en los tribunales.
Para ello y buscando alcanzar el objetivo propuesto en la presente investigación, fue
necesario desarrollar un estudio sobre la causal de adulterio en el Perú, así como un
análisis al contenido y alcance del derecho a la tutela jurisdiccional efectiva y demás que
hagan posible y viable el desarrollo de la misma.
Asimismo, se desarrollaron entrevistas con profesionales especialistas en el área
estudiada con el objetivo de obtener opiniones fidedignas acerca del particular y poder
confrontarlas con los resultados obtenidos en el estudio de campo, lo cual nos permitiría
arribar a un mejor entendimiento del hecho planteado en el problema de investigación y
dilucidar si la hipótesis descrita refleja la información obtenida.
En tal sentido, luego de realizar el análisis teórico pertinente y la contrastación del mismo
con la realidad, se pudo arribar a la conclusión que la falta de criterios para demostrar la
causal de adulterio en el Perú, si incidiría sobre el derecho a la tutela jurisdiccional
efectiva del cónyuge agraviado, hecho que reafirma la hipótesis esbozada.
This research makes an analysis of the regulation of adultery as grounds for divorce in the Peruvian civil law, in order to show how difficult it is for the aggrieved spouse invoke due to the lack of assumptions and limited nature. In response, a rule will only be effective if combined coexists with procedural actions, instruments, means or resources to invoke in order to obtain Effective Judicial Protection. Therefore, from an analysis of national jurisprudence seeks to highlight the failures of invalidity of the judges, when adultery as grounds for divorce arises in court. For this and seeking to achieve the proposed objective in this investigation, it was necessary to develop a study on adultery as grounds for divorce in Peru as well as an analysis of the content and scope of the right to effective judicial protection and others that enable and viable development thereof. In addition, interviews with professionals specializing in the study were developed in order to obtain reliable opinions about the individual and to compare them with the results of the field study area, which would allow us to reach a better understanding of fact raised in the problem research and determine whether the scenario described reflects the information obtained. In this regard, after making the relevant theoretical analysis and contrast of the same reality, it could reach the conclusion that the lack of assumptions to demonstrate the causal adultery in Peru if would impact on the right to effective judicial protection the aggrieved spouse, a fact that confirms the hypothesis outlined.
