In the article 326 of the Peruvian Civil Code establishes that a common-law marriage is a voluntary union between a man and a woman, who are free from impediments to marriage, with the aim of enabling them to fulfil duties and exercise rights similar to those established in marriage. Similarly, it is established that the property society is framed within the regime of the community property society as appropriate or applicable, under the conditions that this has lasted at least two continuous years and there is no impediment to marriage between the partners. If we review Title III, Section II of the Family Law Book of the Civil Code, we can see that the provisions established for the matrimonial property regime allow for the election of the future spouses, that is to say, to opt for the patrimonial regime of a community of property or for the regime of separation of property, this situation being before or after the institution of the marriage (in its articles 295 and 296 respectively). The present tesis of investigation proposes the need to incorporate within our current legislation, the option that the common-law partners of the de facto institution, can also choose the property regime that they freely consider, between that of the community of property and that of separation of property as happens with the institution of marriage; allowing for a sense of equality between both common-law partners.
