The objective of this study has been to examine the incidence of the requirement of prior payment in the contentious tax remedy of claim known in the doctrine as the principle solve et repete, in the same way its configuration in the Peruvian Tax Code and the incidence that it has in Regarding the Right to effective Jurisdictional Guardianship that assists all taxpayers who intend to file an appeal with the Tax Administration. In this context, and with the purpose of being able to fulfill the stated objective, this research has been developed in three chapters. The first chapter analyzes the nature, theories and fundamentals of the solve et repete principle in the international context but above all in Peru. In the second chapter the issues related to the complaint resource were developed, with the purpose of explaining its main characteristics as well as the requirements foreseen by the norm for its filing. In the third chapter, the right to Effective Jurisdictional Guardianship, its essential content and its limitations were addressed to subsequently make the corresponding contrast and obtain the proposed result.
