ABSTRACT The insolvency system is intended to provide debtor companies with legal mechanisms to resolve the economic and financial crisis they may face and be able to cope with them, while facilitating creditors who are the main beneficiaries of the crisis situation. Passes the company, it adopts with previous agreement that they consider convenient to obtain the recovery of their credits and continue generating profits. The causes that initiate a bankruptcy process can be endogenous or exogenous, or as in most cases the combination of both factors. Thus, the increase in prices, such as poor management of the business coupled with bad business decisions, originates the crisis of the company that entails the beginning of a bankruptcy process. It is just that a creditor can start a tender process, and it is precisely the creditors who are responsible for assessing whether this crisis is transient or permanent, and adopt the most efficient decision for the medium or long term. Thus, it is evaluated whether the company is viable, being the creditors in coordination with the shift management chosen by themselves, who decide to opt for their restructuring, otherwise they will opt for their orderly exit from the market, this being the last Which should be sought. The General Law of the Insolvency System crowns the evolution of the Peruvian Insolvency System, an administrative system that differs from the schemes used in most countries of the region and the world, where the phases of the process are mostly judicial. In Peru, the National Institute for the Defense of Competition and the Protection of Intellectual Property - INDECOPI, through its Commissions on Bankruptcy Procedures, conducts the process and ensures its legality, facilitating creditors to adopt agreements Of restructuring for companies with economic and financial viability or the adoption of a settlement agreement carried out orderly under the rules contained in the law. Finally, this effort to get ahead of the company, which unfortunately fell into this terrible chaos, is measured through a Business Restructuring Plan, which allows us to chart the way forward, fulfilling all those stakeholders that depend in one way or another Of the activity of the company, actively participating in the control of expenditure and reinvestment of the capital retained in the time it takes to coordinate, approve and implement the plan, so time proves that a proper and orderly management allows That all in the end benefit.
