The main objective of the investigation is to analyze the pronouncement that the Seventh Plenary Civil Cassation has developed regarding the unregistered real right against the registered credit right. Therefore, the research was based on the study according to the qualitative approach with a design in accordance with the fundamental theory. In accordance with the objective results, it is understood that before the issuance of the Seventh Plenum Casatorio there was a controversy between the unregistered property right versus the registered credit right and, although this had been dealt with by various civil courts, it is through this cassation where a binding precedent was established that favors the interpretation of article 2022 of the Civil Code. In conclusion, unregistered real rights prevail over registered credit rights if these are demonstrated by means of a document of a certain date.
