Abstract: RESUMEN
La presente investigación, nace de la curiosidad de poder delimitar y diferenciar, los elementos
normativos del numeral 1 del Artículo 268 del Código Procesal Penal, es decir, busca describir
independientemente, a los graves; y a los fundados elementos de convicción.
De la misma manera, busca desarrollar el principio de imputación necesaria, el cual se encuentra
en boga al momento de regular las disposiciones de formalización de investigación y los
requerimientos acusatorios, sin embargo, no se ve una aplicación de este principio en los
requerimientos de prisión preventiva, cuando es en estas situaciones donde debería existir mayores
garantías de los derechos del imputado, debido a los principios proporcionalidad y excepcionalidad
que regulan esta medida coercitiva personal.
En este sentido, se ha partido de la necesidad de poder delimitar la actuación fiscal, al momento de
requerir las prisiones preventivas, al considerar que se suelen llevar por otras circunstancias lejos
de ser las legalmente establecidas, lo que se ha desarrollado en el “Capítulo 1. Introducción”, que
enmarca el desarrollo de la investigación, la realidad problemática, así como la respectiva
formulación del problema, su justificación, las limitaciones investigativas y los objetivos que guían el
desarrollo de la tesis.
En el “Capítulo 2. Marco Teórico”, se han desarrollado los antecedentes investigativos del tema
de tesis seleccionado, siendo para el caso únicamente teóricos nacionales; además se ha dispuesto
las bases teóricas, las cuales han sido estratégicamente organizadas en dos capítulos: i) La Prisión
Preventiva; y, ii) El Principio de Imputación Necesaria; finalmente, se ha colegido un compendio de
términos básicos que guiarán al lector a facilitar la comprensión de los puntos teóricos abordados
en la tesis.
En el “Capítulo 3. Hipótesis”, se ha expuesto la parte metodológica consistente en: la formulación
de la hipótesis, la operacionalización de las variables que componen el problema de investigación
para establecer las unidades de medición a considerar en nuestros instrumentos.
En el “Capítulo 4. Materiales y Métodos”, se establecerá el diseño de la investigación, así como
el material de estudio, compuesto por las unidades de estudio, poblaciones y muestras
seleccionadas; así como las técnicas, procedimientos e instrumentos utilizados tanto para la
recolección de datos como para el análisis de la información recabada, en relación a las variables
que componen el problema de investigación de la presente tesis.
En el “Capítulo 5. Resultados”, se consignarán los resultados obtenidos de la aplicación de los
instrumentos consistentes en: i) Guía de juicio de expertos; ii) Guía de análisis documental, y iii) Guía de Análisis jurisprudencial, para, posteriormente, interrelacionarlas en el “Capítulo 6.
Discusión de Resultados”.
Finalmente, se establecerán las conclusiones, tanto generales como específicas, en relación a los
objetivos propuestos en la presente investigación, para luego fijar las recomendaciones
pertinentes, desde la perspectiva jurídica; acompañando las referencias bibliográficas utilizadas
en la investigación, así como los anexos correspondientes.
ABSTRACT The Present Research born out of the curiosity of delineate and differentiate, the material requirements of paragraph 1 of Article 268 of the Peruvian Code of Criminal Procedure, describing the severe; and founded elements of conviction. On the Other Hand , seeks to show if its application is being done correctly , studying: Moreover, constitutional principles governing the Peruvian Criminal Procedural Law, with the purpose to better explain reality on the Application of the graves and founded Elements of conviction , and the decisions made by the judges in pretrial detention hearings. Likewise, this research develops the Principle of Necessary imputation, which is found in vogue now of regular provisions of formalization Research and adversarial requirements, however, it has never been applied on the requirements of Preventive Requirements. When it is in these situations, where there should be greater guarantees of the rights of the accused. In this regard, party of the need to narrow the fiscal action, when required remand prisons, considering that usually carry other circumstances far from the legally established which has been developed in “Chapter 1. Introduction“ where we can find the problematic reality that frames the development of research and the respective formulation of the problem, its justification, the investigative constraints and objectives that guide the development of the thesis. “Chapter 2. Theoretical Framework“, have developed investigative selected theme background thesis being for the national case only theoretical; also it has provided the theoretical bases, which have been strategically organized into four chapters: i) The Peruvian Constitutional Court; ii) constitutional rulings; iii) The Constitutional Binding Precedent; and iv) The Fundamental Rights and its interpretation; It has finally been surmised a compendium of basic terms that will guide the reader to facilitate understanding of the theoretical issues addressed in the thesis. “Chapter 3. Hypothesis“ has exposed the methodological part consisting of: the formulation of the hypothesis, the operationalization of the variables that make up the research problem to set the measurement units to consider in our instruments. In Chapter 4, “Materials and Methods“, the research design study material consisting of units of study, populations and selected samples will be established, and; as well as the techniques, procedures and instruments used for both data collection and for analysis of the information collected in relation to variables that make up the research problem of this thesis. “Chapter 5. Results“, the results of the application of consistent instruments indicate: i) Guide expert judgment; ii) Guide document analysis, and iii) Guide jurisprudential Analysis, to then you interrelate in “Chapter 6. Discussion of Results“. Finally, findings, both general and specific will be established in relation to the objectives proposed in this research, then set the relevant recommendations from a legal perspective; accompanying the references used in research as well as annexes.
