The objective of this research work is to determine how Article 6 of Supreme Decree 004-2006 TR, which establishes a period of conservation of the attendance and exit control record, affects the Right to Effective Jurisdictional Guardianship of the worker, in labor proceedings on claims for overtime pay. To do this, an exhaustive analysis of the doctrinal and regulatory aspects of the research problem was carried out, the study of the Judicial and Supreme Judgments on overtime payment claims, in addition, interviews were conducted with Judges specialized in the matter, culminating with the study of comparative law. From the results obtained, all lead to the conclusion that in practice Article 6 of the Supreme Decree 004-2006-TR, which establishes a period of preservation of the attendance and exit control record [five (05) years after it has been generated], violates the Right to Effective Jurisdictional Protection of the worker, in labor proceedings on claims to pay overtime, since it limits and restricts the worker's right to proof to prove their real and effective working hours, based on the defendant's failure to fully display the attendance control records for the claimed period.
