The present research work aims to show the vulnerability of the principles of Continuity of Labor Relations and Primacy of Reality, which is due to Legislative Decree No. 1057 - Special Administrative Contract for Services. For this, it was decided to detail that the purpose of the research is of a basic type, the approach is qualitative and by its design it is explanatory; Thus, the pertinent constitutional, legal and doctrinal aspects were also analyzed; Interviews were conducted with specialists in the field of labor law, culminating in an interpretive analysis of judicial files. From the results obtained, it is concluded that administrative service contracts violate the principles of continuity of labor relations and primacy of reality, it is because these contracts create a distinction of labor benefits between workers with unjustified functional similarities. This problem in some cases represents a gain for the employer because it allows him to hire personnel with trimmed parts, and a disadvantage for the worker who has fewer parts than he should. That is why, in this research, some alternative solutions have been proposed, with the aim of continuing to prevent the work carried out by workers hired under this regime if they are affected.
