The object of study of this work is to identify the criteria of legal interpretation to consider the non-evolutionary pregnancy as a subsumable case in the assumptions of fact “save the life of the pregnant woman“ or “avoid a serious and permanent evil in her health“. contemplated in article 119 of the Peruvian Penal Code. To achieve this, information has been collected that has clarified the concept of non-evolutionary pregnancy. The position is also assumed that in the factual assumptions “saving the life of the pregnant woman“ or “avoiding a serious and permanent illness in her health“, there are interpretation problems related to the linguistic context (semantic ambiguity) due to use by use of Scientific terms. To solve this problem, the interpretation of a doctrinal and grammatical nature is used. This makes it possible to include the category “non-evolutive pregnancy“ (and its pathological conditions such as: ectopic pregnancy, anembryonic pregnancy, failed abortion, hydatidiform mole, fetal obitum) as a case subsumed in referred factual assumptions of article 119 of the penal code. Finally, as a recommendation formula, a solution proposal is made to consider the non-evolutionary pregnancy as a case subsumed in the factual assumptions of article 119 of the aforementioned code.
