The objective of the investigation is to determine if the granting of legitimacy to the registered owner to formulate opposition in the pending registration procedure for cases of identity theft or forgery of documents guarantees the legal security of real estate. It is a basic type research, with a qualitative approach, a non-experimental design and a correlationalexplanatory scope. The study technique was the interviews that were applied to Public Registrars and Registry Technicians of the Property Registry of the Registry Zone No. IX Lima Headquarters, as well as lawyers specialized in Civil Law and Registry Law, and the documentary analysis. The main result was obtained that the lack of legitimacy of the registered owner to formulate opposition in the pending registration procedure is affecting the legal security of real estate, since the legitimacy granted by Law 30313 to a group of people is insufficient. It has been possible to conclude that opposition to the pending registration procedure is a good protection mechanism. However, Law 30313 has deficiencies, since it has not considered the registered owner as a legitimate person to file an opposition, despite being the direct affected party of identity theft and document falsification.
