ABSTRACT This research was elaborate in order to determine, how the wording civil code 207 article fall in the subjective liability general principle. In the process of this investigation I use theoretical framework along with material and methods consisting in interviews with various professionals with Legal and Liability Act. It also has documentary analysis practical cases, in order to determinate and confirm the approach formulated hypothesis being that the wording the Civil Code 207 Article who has a negative impact on the Subjective Liability General Principle made that affected by the breakdown of the talks partly because the annulment of the act by mistake is not It has the right to be indemnified by the counterparty, leaving it helpless in this way and thus contravening the Subjective Liability General Principle from the Peruvian law. Finally, I suggest the alternative of amending the Article 207 of the Civil Code in such a way to enable the homeless for the contractual relationship that ended in annulment of the act by mistake, looking for a jurisdictional level compensation, thereby respecting the subjective liability general principle from the Peruvian law.
