This monograph analyzes the case of the mine which carries out open pit mining activities, pad leaching and mineral recovery at the Merril Crowe Plant, wich is accused of alleged contamination of Margaritani river stream, as a result of the development of its activities in the northern waste of deposit rock, which would impact water, flora and fauna. The base line conditions of the project were determine by analyzing two (02) samples taken from Margaritani stream in August 2012. Those results exceeded Category 3 ECA Water. That indicates the presence of heavy metals prior to the expansion of the northern waste rock deposit. As for determining the relationship of the mining component “the northern waste of deposit rock”, with the appearance of outcrops, the results obtained from the geophysical prospecting study were considered, where was concluded the presence of leachates in the area where the outcrops were detected. The results of samples of the outcrops located at the foot of the waste rock deposit, which contribute to the tributaries of the Margaritani stream, showed that the Maximum Permissible Limits were exceeded. To determine the existence of contamination in the water sources, considering that the outcrops discharge over the Margaritani stream and its tributaries, a sample was carried out at eleven (11) points located along the Margaritani stream in the month of August of 2017, verifying the contamination conditions of the stream due to exceedances of the values established in the ECA Water, Additionally, the Methodology for determining the Environmental Quality Index of Surface Water Resources ICARHS was used as a reference, where the water of the Margaritani stream was classified as terrible
