The purpose of this work is to analyze the cassation 325-2018 Huánuco, which was submitted by A.C.U. against his ex-spouse D.C.P.C. in the divorce process due to de facto separation. The Transitory Civil Chamber analyzed the aforementioned case according to the request of the spouse for an indemnity in the form of an award of one of the liquidated properties. According to said analysis, they indicated that it does not comply with the criteria of the Third Plenary Civil Ruling, including that it did not evidence a situation of economic disadvantage, due to the fact that she was receiving alimony. Likewise, the minority vote made an analysis, concluding that the injured spouse is entitled to compensation, evidencing that she alone was in charge of the care of the minor children in the postpartum stage and noting the economic disadvantage of the defendant when the situation in which she found herself within the marriage was modified. The difference of positions regarding what to consider a disadvantageous situation in each case varies according to the discretion of the magistrate, so we consider it important to perform an analysis of the economic disadvantages of a divorce after affecting the parties involved in each decision. Finally, it is concluded that this problem must be delimited in order to avoid the violation of the assets of one of the spouses due to an incorrect use of the established criteria.
