This work is based on the decision taken by the Registry Court on the registration of the acquisition of ownership prescription in a registry item, even when it is affected with a 10-year immobilization, in force on the date of request for the registration of the acquisition prescription. This work is divided into three chapters, starting with a first chapter, in which a brief description of the case is made, from the request for declaration of acquisition prescription through notarial means to the final decision of the Registry Court, highlighting the foundations that supported the criteria established in the second instance resolution. In the second chapter, the property, its attributes are defined, in addition to the forms of its acquisition, emphasizing the acquisition prescription of ownership, its requirements and ways to request it, starting from the scope made by different authors. Likewise, in said section we define temporary immobilization and the acts that can be registered in a registry item affected by this figure, taking into consideration what is established by doctrine and the legal system. On the other hand, in the third chapter, the subject matter of this work is explained, which is based on the registration of the acquisition prescription even when a registry item is subject to temporary immobilization. At the same time, an analysis of the legal scope generated by the decision made by the Registry Court in the present case is carried out. Finally, the conclusions of the work are presented.
