In this work, the Sentence issued in Cassation No. 1951-2019-LIMA against hearing order No. 12 is presented and analyzed, which was issued by the Second Civil Chamber Subspecialized in Commercial of the Superior Court of Justice of Lime. The cassation was filed by the executor, with the purpose of declaring the contradiction unfounded and the claim of obligation to give a sum of money founded, the same appeal that was found supported by a security title that was signed in blank by the defendants. . After having carried out a complete casuistry analysis of the present case, consulting books, academic articles and doctrine, the position has been taken in favor of the appeal of cassation since it has been evaluated apart from the application of the principles of literality and abstraction of securities in the present case, this is due to the fact that the bill of exchange [executive title of the present case] has not entered into circulation, and furthermore, the existence of the limitation contained in the security title has been questioned during the first and second instance.
