This work analyzes Sentence 348/2023 issued in File 00949-2022-PA/TC, which is linked to the request for non-application of various articles of the Owners Regulation and Basic Rules of Coexistence of a vacation condominium that prohibit the introduction and possession of pets, for violating the rights to free development of personality and free movement. The Constitutional Court's analysis of the validity of the prohibition of pets in a property highlights the controversy over the constitutionality of the agreements. Thus, the objective of this work is to analyze the autonomy of the will and the freedom of agreements established by the Board of Owners, in order to identify if the right to free development of personality is an available right and if, through the autonomy of will, it can be disposed of, as well as the binding nature of the sentence issued in File 01413-2017-AA/TC. To achieve the stated objective, a synthesis will be established of the actions taken in court until the ruling of the Constitutional Court, as well as the theoretical framework, conceptual bases and particular criteria that supported the sentence, in addition to carrying out a legal analysis of the singular votes. To achieve the established goal, various bibliographic sources were used, which contributed to determining that the right to free development of personality is not an available right, that it cannot be provided through the autonomy of the will and the effective binding nature of the doctrine of File 01413-2017-AA/TC.
