This research has been titled as follows: The political constitution of Peru and the concubinary property regime in the current civil code; and based on the following question: How does the current Political Constitution legally enable cohabitants to opt for the property separation regime? Of this, the general objective has been proposed: Determine how the current Political Constitution legally enables cohabitants to opt for the regime of separation of assets. Finally, and after the information organized and compiled, it has been possible to reach the following general conclusion: The current Political Constitution legally enables cohabitants to opt for the regime of separation of assets; since it regulates exhaustively the rights to equality, freedom and non-discrimination; Likewise, as a supreme norm, the State Constitution is committed to the promotion of the family; and, since concubinage is a source of family generation, it is valid and coherent that said union can enjoy the same prerogatives that marriage enjoys, especially if it has been demonstrated that cohabitation is very similar to marriage.
