The general objective of this research was to determine the legal arguments that will support the regulation of family violence as a cause for termination of the de facto union recognized in Peru. To achieve this, five specific objectives were proposed, the research being reflected in the proposal of modification of article 326° of the Civil Code. In that sense, the work is of applied orientation with a descriptive contrast technique. Inductive, hypothetical-deductive, synthetic-analytical and hermeutical methods were used, and observation and bibliographic research techniques were applied in conjunction with the instruments on bibliographic records and observation guide. This investigation provides a quick solution to the legal situation of cohabitants with recognized de facto unions, so that in the event that they are victims of family violence, they can go to the judge to have the cohabitation relationship resolved. In this way, the cohabitants could unilaterally request termination through the courts, proving family violence through evidentiary means such as the complaint filed plus the evaluations to which it was subjected, such as the Legal Medical Recognition and the Expertise Protocol.
