Our research work is titled the System of evidentiary preclusions in the Peruvian Procedural Code and the right to a fair decision; and it begins with the following research question: How does the system of evidentiary preclusions in the Peruvian Civil Procedure Code prevent the issuance of a fair decision? For this purpose, the general objective has been indicated: Determine the way the system of evidentiary preclusions in the Peruvian civil procedural code prevents the issuance of a fair decision. Finally, after the study carried out, with the appropriate methods and instruments, it has been possible to reach the following general conclusion: The system of evidentiary preclusions in the Peruvian civil procedural code prevents the issuance of a fair decision, because, in the first place , the Civil Procedure Code contemplates a closed and inflexible regime; and, this follows exhaustively from what is stated in articles 189 and 429 of the Adjective Civil Code. On the other hand, having within our Political Constitution categories such as human dignity and due process, from which the right to a fair process or fair decision can be derived; Such preclusions are incoherent, especially if also through the right to evidence, it is possible to exercise the constitutional right of defense; and, this is important, given that this system of evidentiary preclusions, which is mentioned, would be denying any of the parties the possibility of an adequate defense, at any stage and state of the process, ex article 139, paragraph 14 of the same State Constitution
