Resumen: El presente trabajo tiene por objetivo efectuar el resumen del expediente N° 1574-2001, de materia divorcio por causal de separación de hecho por el periodo de cuatro años llevado a cabo por el Octavo Juzgado De Familia De Lima de la Corte Superior de Justicia de Lima , interpuesto por Don Jorge Butrón Alarcon contra Tula Medina Rubio, cabe precisar que en la presente demanda el demandante solicita la extinción de pensión alimenticia respecto a su cónyuge también la división del 50% de los bienes conyugales, tenencia y régimen de visitas de su menor hija Maria Paola Butrón Medina.
Realizado el análisis del expediente en estudio, se constató que el trámite del proceso se inició el 12 de diciembre del año 2001, con la interposición de la demanda declarándola inadmisible mediante la Resolución número Uno de fecha 17 de diciembre del año 2001 , puesto que en la presentación de su demanda no cumplió el demandante con adjuntar copias certificadas el proceso de alimentos señalado en su pretensión de su demanda , y presentando la subsanación el día 07 de enero del año 2002 se da a trámite y se Admite la presente demanda Mediante la Resolución Número Dos de fecha diez de enero del año 2002 .
Luego de ello contestó y se apersono la instancia la Octava Fiscalía de Lima y mediante la Resolución Tres de fecha 22 de enero de dos mil dos se resuelve tener por contestada la demanda presente el domicilio procesal y por ofrecidos los medios probatorios.
También se precisa que la demandada Tula Medina Rubio contesta la demanda con fecha 21 de Febrero del año dos mil dos ,Negando y Contradiciendo la demandada por cuanto indica que no es verdad los hechos que se expone y también presenta tacha contra la constatación policial de retiro de hogar presentado por la parte demandante y mediante la Resolución Cuatro de fecha 07 de marzo del año dos mil dos , se resuelve dar por contestada la demanda por parte de la emplazada y por ofrecidos los medios probatorios , con respecto a la Reconvención planteada advirtiéndose que se trata de una pretensión accesoria : no ha lugar lo solicitado respecto a la cuestión probatoria planteada improcedente por extemporáneo . y presentando apelación la demandada contra la Resolución Cuatro en el extremo de improcedente , mediante la Resolución Seis de fecha 15 / 04 /2002 Se resuelve conceder apelación de auto número cuatro de fecha siete de marzo último sin efecto suspensivo y con calidad diferida .
Seguidamente mediante la Resolución Número Diez de fecha 30 de mayo de dos mil dos se Resuelve Señalar Fecha de Audiencia de Conciliación o de Fijación de puntos controvertidos y Saneamiento probatorio para el día 27 de Julio del año 2002 a horas 10 de la mañana donde ambas partes asisten con sus abogadas luego de ellos se realiza la Audiencia de Pruebas de fecha 17 de Diciembre de 2002 y se deja expedito el expediente para sentenciar.
Se emite SENTENCIA mediante la Resolución Veintiuno con fecha 16 de Junio del año dos mil tres. Donde fallan declarando fundada la demanda interpuesta por Jorge Butrón Alarcón, se declara disuelto el vínculo matrimonial contraído con Doña Tula Medina Rubio, exonerando de la pensión alimenticia otorgada a la demandada por el quince por ciento mediante el expediente de alimentos 901-2000 FC del 2° JPL de la Molina y Cieneguilla , Fundada en parte la pretensiones accesorias y con respecto al régimen de visitas de la hija carece de objeto pues ha cumplido la mayoría de edad , y se ordena elevarse en consulta a la Sala de familia.
La SALA DE FAMILIA de la Corte Superior de Justicia de lima, mediante la Resolución 570.5 ( SENTENCIA DE SALA ) de fecha 19 de Marzo del 2004 vía consulta declararon Nula la Resolución Veintiuno (SENTENCIA DE PRIMARA INSTANCIA) con fecha 16 de Junio del año dos mil tres que declara fundada la demanda de divorcio por causal de separación de hecho y ORDENARON a la Juez de la causa reitere oficio al Segundo Juzgado de Paz Letrado de la Molina y Cieneguilla , a efectos de que precise si se ha determinado que el cónyuge adeuda pensiones alimenticias , antes de emitir nuevo fallo , estando a los considerandos precedente , y los devolvieron.
Luego de emitida la sentencia de LA SALA DE FAMILIA POR CONSULTA, LA PARTE DEMANDANTE PRESENTA RECURSO DE CASACIÓN con fecha 05 de Mayo de 2004 contra la Resolución 570.5 (SENTENCIA DE SALA) vía consulta , la cual se da cuenta en la Resolución de fecha 05 de Mayo de 2004 donde la Sala de Familia concede el Recurso de Casación .
La Sala de Familia expide el Auto Calificatorio del Recurso de CAS:NRO 1537-2004 de fecha catorce de febrero del año 2005 donde declaran procedente el Recurso de Casación ,
luego de ello mediante el Dictamen del Ministerio Publico con fecha 01/07/2005 Opina que se declare INFUNDADO el recurso casación interpuesto por Jorge Butrón Alarcón .
PRIMER PRONUNCIAMIENTO DE LA CORTE SUPREMA mediante la SENTENCIA CAS N° 1637-2004 de fecha 08 de Septiembre de año 2005, donde la DECISIÓN FUE declarar FUNDADO el recurso de Casación en CONSECUENCIA NULA LA SENTENCIA DE VISTA, ORDENARÓN el reenvió de los autos a la Sala de Origen, puesto que la sala de familia declaró nula la sentencia de primera instancia , como si hubiese sido elevado esta en grado de apelación en el cual si se puede pronunciar en los extremos de la sentencia , confirmando , revocando , hasta anular de conformidad con el Articulo 365 del Código Procesal Civil a fin de que expida nueva Resolución con arreglo a ley Regresar a Segunda Instancia y DISPUSIERÓN, la publicación de la presente Resolución en el Diario Oficial “El Peruano” .
Regresando de la Corte Suprema la SALA DE FAMILIA EXPIDE NUEVA SENTENCIA de fecha 14 de Diciembre del año 2005 , DONDE RESUELVE DESAPROBAR la sentencia de Primera Instancia de fecha Veintiuno con fecha 16 de Junio del año dos mil tres , donde declaran fundada la demanda interpuesta por don Jorge butrón Alarcón contra doña Tula Esperanza Media Rubio sobre divorcio por causal de separación de hecho puesto que en el artículo 345-A del Código Sustantivo es necesario corroborar que el demandante se encuentre al día con la pago de la pensiones de alimentos , REFORMANDO la misma IMPROCEDENTE la demanda.
POR SEGUNDA VEZ EL DEMANDANTE INTERPONE RECURSO DE CASACIÓN con fecha 31 de enero de 2006 CONTRA LA NUEVA SENTENCIA DE LA SALA DE FAMILA de fecha 14 de Diciembre del año 2005 y mediante la Resolución de Sala de fecha 31 de enero de 2006 CONCEDIERÓN NUEVAMENTE EL RECURSO DE CASACIÓN ELEVANDO NUEVAMENTE A LA SALA CIVIL DE LA CORTE SUPREMA DE JUSTICIA DE LA REPÚBLICA.
DONDE POR SEGUNDA VEZ LA CORTE SUPREMA DE JUSTICIA DE LA REPUBLICA de fecha 24 de marzo de 2006 donde declaran IMPROCEDENTE el Recurso de casación CONDENARÓN al recurrente a la multa de tres Unidad de Referencia Procesal, así como al pago de la costa y costos del recurso, DISPUSIERÓN la Publicación de la
Presente Resolución en el Diario Oficial “El Peruano” bajo responsabilidad y los devolvieron.
Luego de ello el demandante mediante el escrito de fecha 31 de Mayo del 2006 , solicita al Octavo Juzgado de familia la devolución de sus recaudos , la cual se da cuenta mediante la Resolución Veinticinco de fecha 05 de Junio de 2006 , ordenan la Devolución de sus Anexos presentados.
