This summary is a synthesis of civil process dealing with the granting of public deed; filed by Waymer Arnulfo Benites Cerna against the Cooperativa Centomin Perú_Lima, before the 45° civil court of Lima and signed with file N° 03258_2006, in which, the plaintiff seeks to declare his claim based on his articles: 1351, 1352, 1361, 1412 and in articles: 2, 5, 130, 424, 425 Inc. 8, 547, 548, 554 of the CPC. In the judgment issued by the Forty-fifth Specialized Civil Court of Lima, it fails to declare the claim unfounded, the plaintiff lodges an appeal against the judgment of first instance of June 26, 2006. By means of resolution 12 and under article 367 of the Civil Procedure Code, the 45th Civil Court of Lima resolves: grant appeal to the plaintiff Waymer Arnulfo Benites Cerna. Likewise, the 5th Civil Chamber of the Superior Court in response to the appeal filed resolves: REVOK the resolution of the first instance, reforming it is declared founded accordingly ordered that the defendant ant comply with granting the transferring public deed of ownership to the property subject to the process. The duly accredited Centromin Perú_Lima Housing Cooperative lodges an appeal against the Judgment issued by the 5th Civil Chamber, upholding its claim in two grounds: i) improper application of article 1135 of the Civil Code, ii) what has been violated by art. 197 of the Civil Procedure Code.
