Abstract: Del presente expediente, en análisis del presente proceso se discute si existe una relación obligacional entre la demandante Nancy Melgar Vasquez y el demandado Luis Coca Solorzano, si esta queda acreditada en un título con mérito ejecutivo – la letra única de cambio-.La demandante, presenta como prueba la cambial en cuestión donde se detalla ella como giradora y al demandado como aceptante, ambos con sus respectivas firmas y direcciones, la suma puesta a cobro, las fechas de expedición y de vencimiento, así como el respectivo protesto. En contraposición el demandado, alegó que no mantuvo ninguna relación obligacional crediticia con la demandante, y que el título valor de referencia es falso. Asimismo, indica que en un marco de relaciones comerciales firmó diversos títulos valores en blanco, entre los cuales figura la cambial el cuestión, y que dicho documento lo aceptó del esposo de la demandante, el Sr. Hector Lopez Alor, frente a quién mantenía un adeudo que posteriormente canceló.
Las partes aducen hechos contrapuestos entre sí, correspondiéndole a cada uno de ellos comprobarlos de acuerdo al art. 196° CPC, el cual dispone que la responsabilidad en cuanto a la prueba es para quien reclama un derecho, (afirma un hecho).
