Resumen: La demanda fue presentada por la Empresa Inmobiliaria LP HOLDING S.A. contra el señor Carlos Augusto Martínez Rodríguez ante el 21º Juzgado Civil de Lima, solicitando la restitución del Departamento N° 402, ubicado en el piso 01 del módulo 04 y los estacionamientos 29 y 30 del Conjunto Habitacional “Las Lomas”, situados en “Calle Paseo del Prado N° 110, distrito de la Molina, provincia y departamento de Lima, por incumplimiento de pago.
La demanda se presenta ante el Juzgado Civil; el juez califica de forma negativa, declarándolo inadmisible, el demandante subsano las omisiones advertidas; es así, que la Judicatura admitió a trámite la demanda y emplazo al demandado para que conteste dentro del término de Ley, el demandado formula cuestionamiento probatorio en la modalidad de tacha de documentos; asimismo, contesta y contradice la demanda dentro del plazo legal. El encartado cuestionó las pruebas ofrecidas, alegando que los documentos han sido dirigidos a un domicilio distinto al consignado en las cláusulas del contrato y al no ser recibidas por su persona no se han producido los efectos legales, señala que el accionante previo a resolver de pleno derecho el contrato ante incumplimiento de pago por parte del comprador debió intimarlo por el plazo de diez días; sin embargo, ello no ha sucedido, dado que no ha recibido comunicación alguna por la parte interesada aduciendo que no habría operado resolución contractual.
El Juzgado en primera instancia declara improcedente la tacha y fundada la demanda, la Sala Superior revoca la sentencia, el demandante al no estar de acuerdo con la decisión interpuso el Recurso de Casación, la Sala Civil Transitoria de la Corte Suprema declararon fundado el Recurso de Casación, nula la resolución de vista, ordenando que la Sala emita nuevo fallo; por lo que, la Sala Civil revocaron la sentencia de primera instancias y reformando declararon infundada la demanda.

The lawsuit is filed before the Civil Court; the judge qualifies negatively, declaring it inadmissible, the plaintiff remedies the omissions noted; Thus, the Judiciary admitted the lawsuit to process and summoned the defendant to answer within the term of the Law, the defendant formulates evidentiary questioning in the modality of crossing out documents; It also answers and contradicts the claim within the legal deadline. The accused questioned the evidence offered, claiming that the documents have been sent to a different address than the one stated in the clauses of the contract and not being received by his person there have been no legal effects, indicates that the actant prior to resolving fully right the contract due to non-payment by the buyer had to be intimate for a period of ten days; however, this has not happened, since it has not received any communication from the interested party claiming that it would not have operated a contractual resolution. The Court in the first instance declares the strike unfounded and the lawsuit founded, the Superior Court revokes the sentence, the plaintiff in not agreeing with the decision filed the Appeal, the Transitional Civil Chamber of the Supreme Court declared the Appeal to be founded Cassation, nullifies the resolution of view, ordering that the Chamber issues a new ruling; Therefore, the Civil Chamber revoked the judgment of first instance and reforming declared the claim unfounded.
