Resumen: En la actualidad vemos que muchos jueces dictan la medida de prisión preventiva, para poder tomarse el tiempo de investigar al procesado, pero que pasaría si el acusado no cometió el delito, y aun así estamos quitándole su libertad por meses o quizás por años.
Pudiendo identificar que la figura de prisión preventiva vulnera el principio de inocencia, tipificado en el numeral 3 del art. 76 de la Constitución Política de la República.
Conclusiones:
- La detención preventiva debe dictarse solamente cuando existan indicios mayores que tenga una gran afectación social (evidencias claras), muchas veces estas se dictan solo por situaciones políticas, económicas, atentando al derecho de libertad de las personas.
- He llegado a la conclusión que no importa el grado de afectación que sufre el imputado que ha sido privado de su libertad, que se da principalmente en su estado psicológico: depresión, baja autoestima a demás esto provoca la inestabilidad familiar, entre otros.
- Asimismo, cabe resaltar que se dicta en nuestro país la prisión preventiva de manera desmesurada.
- Los jueces deberían ser capacitados continuamente para crear en ellos un mejor criterio discrecional.

Conclusions: - Preventive detention should be issued only when there are major signs that have a large social impact (clear evidence), often these are dictated only by political, economic situations, undermining the right of freedom of the people. - I have come to the conclusion that it does not matter the degree of affectation suffered by the accused who has been deprived of his freedom, which occurs mainly in his psychological state: depression, low self-esteem, and this causes family instability, among others. - It should also be noted that preventive detention is imposed in an excessive manner in our country. - Judges should be continuously trained to have a better judgment discretionary.
