Resumen: En la década de los 80 se inicia una gran problemática internacional “el lavado de activos”, el cual consiste en que el dinero ilícito aparezca como capitales legales mediante ciertos procedimientos (depósitos en instituciones bancarias, mezcla de fondos, compra de bienes de alto valor, etc.). Así pues, para alejar el rastro delictivo, el dinero es transferido de un país a otro a fin de dificultar su persecución política y facilitar su encubrimiento.
Quienes se dedican a este crimen, buscan beneficiarse de los distintos sistemas jurídicos alrededor del mundo. Las falencias de sus contenidos les permiten eludir las leyes. Por este motivo se crearon documentos internacionales como la Declaración de Basilea, la Convención de Viena de 1988, El Acta de Bélgica, entre otros, los cuales tienen gran alcance a nivel mundial.
Nuestra vigente legislación (Ley No. 27765), contempla de manera precisa leyes contra este delito, las cuales incluyeron a través del Decreto Legislativo N° 1106 del año 2012, una modificación sustancial en el marco de regulación penal a efectos de no ser necesario que el delito haya sido descubierto, como se entendía en la legislación anterior, para que pueda realizarse la investigación.
Cabe precisar, que a pesar de estos cambios, la corrupción de funcionarios públicos ha ido creciendo considerablemente en esta última década. La investigación de la UIF indica un gran número de operaciones sospechosas realizadas por funcionarios públicos; tal es el caso de gobernadores regionales y recientemente ha tocado fondo con la investigación interpuesta por el Ministerio Público contra el ex presidente Ollanta Humala y su esposa Nadine Heredia por este grave delito.

For this reason they were created international documents such as Basel Declaration, the Vienna Convention of 1988, The Act of Belgium, among others, which have a global reach. Our current legislation (Law No. 27765) provides for precise laws against this crime, which included, through Legislative Decree No. 1106 of the year 2012, a substantial change in the framework of penal regulation in order not to the crime has been discovered, as understood in the previous legislation, so that the investigation can be carried out. It should be noted that despite these changes, corruption of public officer has grown considerably in the last decade. The UIF investigation indicates a large number of suspicious transactions carried out by public officials; such is the case of regional governors and has recently hit bottom with the investigation filed by the Public Ministry against former president Ollanta Humala and his wife Nadine Heredia for this serious crime.
