The separation of fact as a ground for divorce represents a legal procedure to dissolve the marriage due to the actual separation of the spouses. The Third Civil Casatory Plenum has established that this type of divorce involves economic compensation to the affected spouse, in recognition of the duties inherent to family solidarity, aiming to mitigate and compensate for the differences caused by the separation. The Third Plenum has established that the judge, in their role to clarify who the affected spouse is, may request ex officio evidence, respecting two essential limits: It is necessary to restrict the presentation of evidence to the facts presented by the parties and to ensure the right to defense. This critical research addresses the Third Binding Rule of the Tenth Civil Casatory Plenum, Cassation No. 1242-2017 Lima Este, which sets specific limitations on the use of ex officio evidence. However, it does not explicitly admit that these limitations should apply to divorces due to separation of fact, which affects the decisions of the Third Plenum. The lack of clarity on the limits to the use of ex officio evidence in these contexts results in a legal loophole, potentially compromising the rights of the non-affected spouse. In summary, it is necessary to recognize and apply the limits to the use of evidence established by the Tenth Plenum in divorce processes due to separation of fact, which will serve as a binding precedent that complements and clarifies the guidelines of the Third Plenum.
