Currently, women are victims of discrimination during pregnancy while pursuing their professional academic formation; however, the impact on the conceived, who is a subject of rights and receives legal protection as a defenseless being conditioned to be born, is rarely mentioned. This research examines the assessment of violated rights of the conceived resulting from the expulsion of a pregnant student from CITEN. The focus of the study is on the conceived, as Justice Sardon issues a dissenting opinion, briefly addressing this rights-bearing individual and concluding, for other reasons, in line with the majority opinion. An analysis of the current case reveals that the highest interpreters of the Constitution have not respected the legal protection of the conceived, leading to a state of vulnerability. Therefore, it is concluded that the Constitutional Court has infringed upon the conceived as a rights-bearing individual by not independently evaluating their situation in relation to the pregnant student. Consequently, it is recommended to establish preventive and remedial alternatives, such as modifying institutional policies in military training centers and implementing measures o programs to support academic and professional endeavors.
