This case will analyze Resolution No. 0032-2022/CPC-INDECOPI-ANC. This controversy is framed in the area of law known as Consumer Law. In this case, Saga Falabella S.A. (the defendant) intends to appeal all aspects of Resolution No. 0232-2022/INDECOPI-CHT, having previously acquiesced to the complaint filed against it. Consequently, the Court for the Defense of Competition and Intellectual Property (Specialized Chamber for Consumer Protection) declares the partial nullity of the Resolution that granted the appeal filed by the defendant, declaring the appealinadmissible. This case is worthy of analysis for this paper, since we will explain the problems related to the proper use of the appeal in administrative proceedings, an issue of great relevance for the protection of consumers' interests. Likewise, we will highlight the application of figures of Procedural Law, such as the “allanamiento“, on which we will make a detailed analysis of its evolution and application in the administrative field. Finally, we will examine both its use before and after its introduction in the administrative venue, and we will present the different pronouncements of the Specialized Chamber on Consumer Protection of INDECOPI; in addition, we will enrich our analysis with the inclusion of the doctrine of various authors on this subject. In this order of ideas, the resolution chosen for this paper has a special consideration as it is a precedent of mandatory observance, which provides greater legal certainty by safeguarding the interests of consumers by prohibiting obstructionist practices by suppliers.
