In the administrative contentious lawsuit filed by ENTEL S.A.C., it requested the annulment of Management Resolution No. 083-2014-MDL/GM and Sub Management Resolution No. 0013-2014-MDL-GDU/SIU, as well as the authorization to install telecommunications infrastructure in a property in Lima. In the first instance, the Thirteenth Specialized Court in Administrative Litigation of the Superior Court of Justice of Lima declared the lawsuit partially founded. Since, it was decided to apply a special rule over a general rule in the case. The second instance confirmed this decision, ratifying the nullity of the resolutions and the inadmissibility of the request, without additional costs. However, the appeal was considered unfounded because the District Municipality of Lince properly applied the local legal provisions when denying the request. It was argued that the zoning established in Ordinance No. 1017-MML indicated that the area was residential, incompatible with the installation of telecommunications infrastructure. Within the cassation, it was pointed out that the competences of the municipalities in urban planning, including zoning, cannot be ignored by telecommunications regulations. Based on the above, the present research work will analyze the congruence and relationship between the relationship between the Constitution and the sectorial regulations on telecommunications infrastructure. Thus, the importance of this work arises from the normative and hierarchical connection existing in the Peruvian legal framework based on the specialty of the norms
