The present work aims to analyze the ruling issued in Case No. 02302-2014-PHC/TC related to a Habeas Corpus petition filed by Mr. Marcelino Quispe Callo, on behalf of minors with the initials A.H.M and C.A.H.M, regarding whom a ruling declaring the extinction of parental authority was issued, which would have violated their fundamental rights. Within the analysis, we will have the opportunity to review the aforementioned ruling, analyzing the decision made, the individual votes of the justices, as well as the necessary conceptual foundations to reach the decision. Likewise, we will address topics related to habeas corpus against judicial rulings, the best interest of the child, the right to family, and related rights to provide a comprehensive critical analysis of the ruling. To conduct the analysis of the present case, bibliographical references related to national and international authors, jurisprudence of the Constitutional Court, as well as applicable legislation, have been used, which, after careful analysis, have led us to understand and develop the work in an integral manner. Based on the foregoing, the authors consider that, in the present case of a habeas corpus against a judicial resolution that extinguishes parental authority, it constitutes a valid constitutional procedural mechanism, but not the most optimal one, therefore the amendment of article 408° of the Civil Procedural Code is suggested, which will be developed in the analysis of this paper.
