The objective of this work is to analyze the cassation ruling 16618-2023 issued by the Supreme Court of Justice of the Republic. The case in question presents the treatment that has been given to the economic remuneration for the use of groundwater over time, thus, through a review of the laws that have been issued, and subsequently repealed, in order to regulate the use of this natural resource, the court presents its position on the interpretation of the same, to, finally, resolve with a firm position, the conflicts derived from the payment. Our legal interest lies in the binding precedent that arises from this case and establishes the legal relevance of the cassation rulings. Although the court rules on the application of the fee for the use of groundwater, we consider that its resolution has guaranteed uniformity and coherence in the application of the law, which promotes efficiency in the administration of justice, avoiding resources and unnecessary litigation; Well, as is known, the supreme court holds the highest judicial authority in the Peruvian State and has the responsibility of examining and resolving appeals filed against sentences issued by lower courts. In light of the above, this work is aimed at carrying out an exhaustive analysis of the Cassation Judgment 16618-2023 in order to determine the relevance and binding application of the cassation rulings as stated in the binding precedent that derives from the cassation in question.
