This thesis addresses the Full Court Agreement (Acuerdo de Sala Plena) N° 006-2021/TCE, in which it was determined the time when the infringement was committed for not fulfilling the obligation of concluding the agreement. In addition, this paper explains the reasons why it was issued the Full Court Agreement and if the unfulfillment of concluding the agreement arises before the lack of signing the document that contains it or by the unfulfillment of the preceding stages to the conclusion of the agreement. Furthermore, the stages of the conclusion of agreement will be detailed and the two positions of the members of the State Contracting Court (Tribunal de Contrataciones del Estado) will be analyzed, concerning the opportunity in which the infringement is configured controversial. Finally, once the positions have been defined, it will be explained whether or not it is possible to justify the infringement by the conclusion of agreement and what are the guidelines; also, the scenarios will be reviewed where the entities declare the loss of the bid, however, the State Contracting Court does not second that position.
