In the present work of professional proficiency, we will address an existing pathology in public records, which consists of the double registration that deal with the same real estate, which generates a controversy between two owners of the same property to determine which right is the preferred one. and real owner of the real estate It should be noted that one of the main characteristics of property is exclusivity, that is, it can only have one owner of the entire property or, failing that, several owners, who are owners of a portion of the property. Along these lines, the Peruvian legal system has stipulated the figure of the best property right, which consists of determining whether between two people who claim to be owners of the same property, who is the legitimate owner of the same according to what is stipulated by the Civil Code has stipulated the following articles 948, 1135, 2016, 2017 and 2017-A. It was concluded in this research work that the action of the best property right acts as a solution mechanism against registry duplicity, because the application of the best property right is related to the registry principles of priority and impenetrability. , which establish the preference of the right over those who claim to be owners of the real estate; Consequently, once the preference has been determined and which is the preferred registry item, we proceed with the cancellation of the registry item that gave rise to the duplicity.
