This research paper will examine Constitutional Court Ruling No. 446/2020, issued on August 4, 2020, which upheld the amparo claim filed by “Sociedad Agrícola San Agustín S.A.” (SASA) against the “Ministerio de Vivienda, Construcción y Saneamiento” (MVCS). In consequence, the Constitutional Court mandated the payment of just compensation to SASA for the violation of its property rights during the expropriation of 36,270 square meters of the “Fundo San Agustín” which took place in the 1970s. For the purpose of this analysis, academic resources such as books, theses, legal articles, jurisprudence, and pertinent laws were utilized. This study will cover concepts related to the amparo proceeding, the exception of extinctive prescription, the constitutional grievance remedy, the social function of property, and the evolution of the legal framework of expropriation in Peru, with particular emphasis on the objective of just compensation. Moreover, the ruling will be critically examined regarding the continuous violation of SASA's property rights, leading to the non-application of extinctive prescription in the case under review. Ultimately, through comprehensive argumentation, it will be concluded that the current regulatory framework for expropriation procedures ensures the effective protection of the affected party and facilitates the implementation of large-scale projects.
