Abstract: En el presente Trabajo de Suficiencia Profesional se aborda un análisis crítico sobre la casación N° 2845-2017-Lima Norte expedida por la Corte Suprema. Dicha casación fue interpuesta por la demandada contra la sentencia expedida por la Sala Civil Transitoria de la Corte Superior de Justicia de Lima Norte, la cual revocó la sentencia apelada que declaró infundada la demanda de prescripción adquisitiva de dominio y reformándola, la declaró fundada.
La Corte Suprema declaró fundado el recurso; en consecuencia, se casó la sentencia de vista; por ende, se confirmó la sentencia apelada que declaró infundada la demanda de prescripción adquisitiva. Sin embargo, dicha casación tuvo voto en minoría, el cual declaró infundado el recurso, y por tanto no se case la sentencia de vista.
En el presente documento, se evidencia el escaso análisis sobre los requisitos de la prescripción adquisitiva, tales como: la posesión pública, pacífica, continua y como propietario del bien inmueble por un periodo de tiempo determinado por ley. Por consiguiente, se analizará el fondo de la controversia evaluando las distintas opiniones de autores reconocidos en la rama. Gracias a ello, ha sido posible criticar la postura de la Corte Suprema y tomar una posición.
En el primer capítulo desarrollaremos la síntesis de la sentencia del recurso mencionado, en el segundo capítulo analizaremos el marco teórico sobre los requisitos de la prescripción, en el tercer capítulo abordaremos una opinión crítica sobre ello; finalmente, incluiremos las conclusiones y referencias.
In the present Work of Professional Sufficiency addresses a critical analysis of the cassation No. 2845-2017-Lima Norte issued by the Supreme Court. Said cassation was filed by the defendant against the judgment issued by the Transitory Civil Chamber of the Superior Court of Justice of North Lima, which revoked the appealed judgment that declared the claim of acquisitive prescription of ownership unfounded and reformed it, declaring it founded. The Supreme Court declared the appeal well-founded; consequently, the judgment was annulled; therefore, the appealed judgment declaring the claim of acquisitive prescription unfounded was confirmed. However, this cassation had a minority vote, which declared the appeal unfounded, and therefore, the judgment on appeal was not upheld. In the present document, it is evident the scarce analysis of the requirements of the acquisitive prescription, such as: the public, peaceful, continuous possession and as owner of the real estate during a period of time determined by law. Therefore, the merits of the controversy will be analyzed by evaluating the different opinions of recognized authors in the field. Thanks to this, it has been possible to criticize the position of the Supreme Court and to take a position. In the first chapter we will develop the synthesis of the sentence of the mentioned appeal, in the second chapter we will analyze the theoretical framework on the requirements of the statute of limitations, in the third chapter we will address a critical opinion on it; finally, we will include the conclusions and references.
