This paper studies several peculiarities observed in the sentence issued by the Constitutional Court, which focuses on the exclusion of personal Facebook accounts from the Peruvian legislation, regarding the violation of the right to informational self-determination. The law specialized in the protection of personal data is studied, which indicates that before the manipulation of personal information in personal data banks, the owner of the information has the right to manage it. This information is protected by the right to informative self-determination, whose defense mechanism is called habeas data against technological dangers. In the judgment under study, the plaintiff's right to informational self-determination is not safeguarded. Therefore, Justice Monteagudo, in his vote, supports the decision of the Chamber, but makes two clarifications. First, he highlights the amparo action as an alternative route. Second, he does not share the position assumed by his colleagues of the Constitutional Court regarding the fact that a personal Facebook account does not have the characteristics of a data bank. By virtue of this, it subscribes in its entirety to the clarifications made in the vote, which adheres to the decision of the judgment. In this sense, this analysis concludes that the special law has been applied correctly, and supports the recommendation to file an amparo as an alternative means of defense.
